These terms apply to the Disc Avenue website and orders placed through our online store. Disc Avenue is based in Bundaberg, Queensland, Australia, and specialises in pre-owned DVDs, Blu-rays, TV series, box sets and other physical media.

1. These terms and your rights

“We”, “us” and “our” refer to the business operating Disc Avenue. “You” means the customer or website user. If you order for another person or business, you must be authorised to do so. Your order is governed by the terms available when you place it, together with our Refund policy, Shipping policy and Privacy policy.

Nothing in these terms excludes a guarantee, right, remedy or responsibility that cannot lawfully be excluded. Australian Consumer Law protections take precedence, including for eligible purchases of pre-owned goods.

2. Physical media, condition and compatibility

Unless the listing expressly says otherwise, our media listings are for pre-owned physical discs, not streaming access or digital downloads. Read the listing for the title, format, edition, region, language, subtitles, included discs and condition. Check that your player supports the format and region before ordering. Ask us if information is unclear.

Cases, covers and discs may show the wear described in the listing. A reference cover image does not override the written condition or included-item details. We remain responsible for accurate descriptions and applicable quality guarantees. We will not substitute a materially different title or edition without your agreement.

Digital-copy codes, downloads and subscription benefits are included only where the listing expressly confirms them; a code in a pre-owned case may already have been redeemed. Purchasing a disc does not grant rights to copy, distribute or publicly screen its content beyond what the law or rights holder permits.

3. Website use and accounts

Provide accurate order information and use payment methods you are authorised to use. Keep account credentials secure and tell us about suspected unauthorised access. Do not misuse another person's information, interfere with the site, introduce harmful software or infringe others' rights.

We may take proportionate steps to address fraud, unlawful conduct or security incidents. This does not remove rights concerning an existing purchase, refund or complaint.

4. Orders, availability and acceptance

Placing an order is an offer to purchase at the displayed total. We accept it when we communicate acceptance or dispatch the goods, whichever occurs first. A message expressly described as only acknowledging receipt is not acceptance. Many pre-owned titles are available in limited quantities.

Before acceptance, we may decline an order for a genuine reason such as unavailable stock, an obvious listing error, failed payment, suspected fraud or an address we cannot service. We will notify you promptly and refund payment taken for an order we do not accept.

After acceptance, we will not cancel simply for convenience or increase the agreed price without your agreement. If we cannot supply an accepted order, we will contact you to arrange a lawful solution. You do not have to accept a substitute or store credit. Refunds for cancelled supply include the associated delivery charges where applicable.

5. Prices, payment and promotions

Prices are in Australian dollars and include GST where applicable. Shipping and other applicable charges are disclosed before purchase. Payment must be successfully received or authorised before dispatch unless we agree otherwise. Payment providers' terms do not replace our responsibilities as the seller.

Price changes apply to future purchases. If we identify an error before acceptance, we will explain it and give you the choice of a new purchase on corrected terms or a refund of payment taken. An error does not give us an automatic right to change an accepted order.

Promotion conditions are those disclosed with the offer. Discounts do not remove consumer guarantee rights.

6. Changes, delivery and cancellations

Contact sales@discavenue.com.au promptly if you need to change or cancel an order. We will check its status. A voluntary change may not be possible after dispatch, but eligible goods can be returned under our 30-day change-of-mind offer.

Available delivery services and charges are explained at checkout and in our Shipping policy. Estimated dates are not guaranteed unless expressly agreed. We must supply within an agreed timeframe or otherwise within a reasonable time, and will work with you to resolve significant delays, loss or damage.

For delivery we arrange, risk of accidental loss or damage passes on delivery to you or your authorised recipient, or proper delivery under your express authority to leave. Handing a parcel to a carrier does not alone transfer that risk. Ownership passes on full payment, subject to applicable law. Neither event removes rights concerning faults or breaches for which we remain responsible.

7. Returns and faults

For a change-of-mind return, contact us within 30 days of receiving the goods. Return items in the same condition as received with all supplied contents; complete sets must be returned together. The Refund policy explains conditions, costs and the return process.

The 30-day period and change-of-mind conditions do not limit statutory claims. If goods fail an applicable consumer guarantee, we will provide the remedy required by law. Contact us directly about playback faults, incorrect items, damage or a material mismatch with the listing.

8. Content, IMDb and other services

Disc Avenue branding and website content belong to us or the relevant rights holders. You may use the site and save order information for legitimate shopping purposes. Other use requires permission unless the law allows it.

IMDb links are provided for film and series information. IMDb is an independent service with its own content, terms and privacy practices. An IMDb entry does not establish the exact edition, region, condition or extras supplied by Disc Avenue; those details are in our listing.

We take reasonable steps to keep the site available, but maintenance or technical problems can interrupt access. You can contact us by email about orders and support. An outage does not remove your rights.

9. Privacy, responsibility and disputes

Our Privacy policy explains how we handle personal information. Ordering or accepting these terms is not, by itself, consent to marketing.

Each party remains responsible to the extent required by law. We do not exclude liability or compensation that cannot lawfully be excluded, including remedies for consumer guarantee failures.

Updates apply to future transactions and do not retrospectively change an existing order without agreement or lawful authority. Queensland law applies subject to mandatory laws relevant to you. You may approach a consumer protection agency or any court or tribunal with jurisdiction.
